I would think this would help resolve the issue.
If you are legal in your state, then your insurance should cover you.
I didn't check every state, only mine and CA because the thread where I found this mentioned that CA requires DOT tires.

In this sue happy society do you really want to be the one that determines case law?

Same applies to the non-DOT windshields... Even though most of the Lexans probably are "stronger" than the safety glass. But their failure modes are shards not crumbles.

“Wanton Disregard”! That is what the insurance company is going to say or the other parties lawyers will say if they do a little digging and find out you have illegal tires or any other equipment on your car! And then you are screwed!!!!!!
