Getting money from state Farm for crash

Well, I had a lady ran a red light and smash the front right of my backdraft this weekend. Her insurance is State farm. Has any one had any exp. with dealing with accidents and insurance with cobras? I'm hoping that I won't have a big fight to get the money to get my car fixed.

Sounds like an intersection accident. I thought ins. comp's like to assign "blame" in percentages. she 75% you 25%.

At an intersection even tougher, 50-50 unless she got a ticket. After all, YOU say she ran a red light, her "song" may have changed all ready!

There is a reason that I have State Farm. They are one of the biggest SOB's on payouts...and personally I would rather have them on my side than against me.

The big question is going to be did she receive a ticket? If she did I would think they don't have a choice but to pay for repairs.

I have had State Farm for many years and am pleased with them. Their rates on the Cobra were much better than the specialty agents I've seen advertised. Did you get an independent witness or two to the event? That would help in case there wasn't a ticket involved. Good luck. Rich

A tip from an industry insider. Whether the other driver received a ticket or not will not be the ONLY deciding factor in liability. Adjusters are trained to make their own decisions and do not rely only on police reports. Often in busy cities, the report only says "car 1 hit car 2" and is of little help. If there are no witnesses, it may be a tough choice.

My recommendation would be to file with your own insurance company. They will take care of your car regardless of who is at fault. Let them deal with it. If they feel you are not at fault, it will not hurt your rates, and they will go after State Farm to get their money back. Not to mention the Snake Farm adjuster probably is used to writing Camrys and Accords, and may not be able to write a good estimate on the Cobra.

Best of luck.

Was curious as to how fast she was going when she hit you? Did you get hurt. How well did the front end hold up. Is the frame bent? Did she get hurt?

Also, try and remember anything the other driver said. When a young girl came out of a driveway and caused my Cobra to hit her illegally-turning car, she said "I didnt see you." Instead of "Where did you come from?" Little things like that help to prove fault, especially with no witnesses.

The car held up pretty well i think. The frame is fine and only the lower contral arm was bent. The fiberglass is toast on the right side from mid wheel well to the right quick jack. I think the tire took the brunt of the hit. I have a witness so I think it should all work out I'm just worried that the insurance company going to try and under pay the claim.
