Will this site be the next to be sued by Shelby?
 
So the ffcobra site and Factory Five are the latest to feel the Brand protection campaign from the lawyers of the Carrol company!

Personally I think they need to be a little nicer to their fellow car guys and remember that imitation is the highest form of flattery! Unfortunately the lawyers not the car guys seem to be running things these days. :(

We have a good relationship with Carroll and his companies. We have always respected the trademark and copyright requests of any company that has issue with site contents.

Thanks for the answer. And the reason for that is that we have moderators and an administrator that not only do their jobs, but keep in touch with what is going on and make sure that we do not cross any lines.

I half expect to be sued just for saying it. :)

But that's OK, my lawyer is one nasty bad-a$$. Even I don't go near him unless he's been fed.

We used to do a crate motor we called a "Cobra Classic"

Ford had us remove any reference to the word Cobra.......we can't ever refer to a "Cobra Kit Car".....

I'm not a lawyer, just someone trying to understand the process.

Does your relationship constitute a legal agreement to use the trademark name that makes up your website's title? Does it extend to cover the advertisers (other than CSE & affiliates) that use it in marketing their products here? Is there joint liability in allowing this to happen without express written approval of CSE et al?

Are we as forum members at risk of being included in civil action by way of our membership here?

I realize these are probably dumb questions, but lawyers seem to like shake ALL the trees around to see which one the money falls from. I know I would be nervous about the grounds for his current legal barrage spilling over here if I were ever in your position.

As someone posting for the first time here...maybe you should ask those questions at the FFR site.

As Ron noted, we have a good relationship with all the various companies and suppliers, rather than being devoted to one marque. We have no interest in having legal disputes involving others being dragged over here.
