Explain this "Cobra"
 
Question:

Why is it that Ford could advertise Cobra on their Mustangs, when this is supposed to be registred with Shelby.

And why are they called Cobra Mustangs ?

Ford owns the Cobra name, bought it years ago from Shelby. They allow/license Shelby to use it as some kind of sweet heart deal. Who knows what the "real" details are of their deal.

Rumor has it Ford paid Shelby a dollar for the name, back in the day. I suspect something closer to the truth is that Ford wrote off a huge debt that Shelby owed them in some way and that's why they only paid a dollar, kept the lawyers happy.

Carroll Shelby sold the trademark to the name "Cobra" to Ford for $1 back in the 1960s. Ford has been using the moniker on Mustangs, Torinos and whatnot for decades now. I assume Shelby is licensing the name from Ford for his continuation cars.

As far as the kit car/replica industry is concerned, Shelby has been asserting his trademark rights to the Cobra body shape and has been suing manufacturers on this basis as they have not been licensing the design and paying royalties to him.

I'm no lawyer, but that's how I understand things to be.

He lost the suit on the general "body shape" of a Cobra, which then passed into the public domain. No foul to recreate the basic shape by anybody these days, just don't use the name "Cobra". If Shelby don't get you, Ford will!

Last I heard he was registering many other versions of the various names used for Cobras through the years. "427 Cobra", for instance.
