He's trying again !
He should have registered the name back in the days. I like Carroll and what he's done for American racing ect......but, it's time to give it UP ! |

I think I could be in trouble here!!!
I named my daughter Shelby... |

...which is then passed on to the consumer. Yup, we now have to factor in the blood sucking lawyer fees when we construct a new business model. The way the complaint on file reads, I would imagine this site would be open to similar litigation as ffcobra. That would really suck if this site where shut down like csx427sc.com was. |
unfortunatly that is true of most companys
|
As ENTDOC says ... true of most companies . I was looking for a source to sell some collectible dolls for a friend of mine and went to a web site in Atlanta ...I think it was the Atlanta Doll Collectors ... and it said it used to be they used to be called the Barbie Doll Collectors something or other , but Mattel had come after them and forced them to change the name and stop using Barbie . Looks like Shelby isn`t the only one who gets their thongs in a wad .

First, csx427sc.com was shut down NOT by Shelby, but by an unresolved problem with a car owner whose property was used on the site, with disputed data. This WAS NOT a trademark issue. With respect to ffcobra vs. this site, the situation is really quite different...and I will leave it at that. We run an independent enthusiasts' site with no manufacturer's affiliation, with proper attribution of copyright and trademark across the board. That being said, let me add some caution. Certainly, the legal action is news within our hobby and worthy of topics on this and other forums. However, on THIS forum, we would ask that all refrain from posts that are out of the scope of discussion of the facts relating to the legal action and the parties involved, i.e, FFR and others named, and CSLI. We support Bill P. in his efforts to resolve the issues that affect his forum. We do not want to see personal insults slung at CS or anyone else, for that matter. Besides observing that as a courtesy... you will do no good by creating a stick-in-the-eye post toward them on OUR forum, ClubCobra. We don't want that and we don't need that. Thanks ron ClubCobra Moderator |
Aaaah Ron you are on the Australian forum.... Call that a knife..? Now this is a knife..Crocodile Dundee.. We don't sling muck over here.. Seriously though a good point to make. We do not want to have legal staff trawling for supporting evidence and finding a whole new litigation path on this forum. Guess it is a simple look, read and just keep out of it... and send some support via Paypal.. This is a public forum and care must be taken with the content. Bernie |

1.) FFCobra.com is an independent site with no affiliation to any manufacturer, including FFR. They did not start the site, I did. They have NO SAY over what gets said or done on my site. FFR has been paying ClubCobra.com for ads longer than they have paid me. They only started paying for an ad in 2005 and stopped in 2008. 2.) Ron says that ClubCobra.com uses "proper attribution of copyright and trademark across the board" but forgot to say that so does FFCobra.com. ClubCobra.com adopted my copyright and trademark notice at the bottom of every page. We use the same "notice". If you use the Wayback web site you can see both sites in July 2002. My site has the same notice at the bottom of the page as I do today. Notice that ClubCobra.com did not not use this "notice" before FFCobra.com. Someone from ClubCobra.com copied my trademark notice at a later time. http://web.archive.org/web/200207172...w.ffcobra.com/ http://web.archive.org/web/200207262...clubcobra.com/ Thank you, - Bill |

Good luck with your efforts. |
Bill...not sure we appreeciate the remarks about alleged comparisons with your site given Ron's statement about this forum's position and policy. Note we are not a one-marque site.
Thread's now closed...and we'll now ensure that discussions concerning your problems stay somewhere else. It's a koolaide thing. ;) |
