Well today they upped my pain meds to try and take the edge off a bit more. I also got sent for more X-rays and fitted for a brace. The pain even with increased meds is excruciating and I used to think I was a pretty tough guy..

I called the CHP today and there appear to be two reports... One for the pothole and then a seperate one where the bike and I became two. I assume this is a good thing that they made the distinction.

Had the same thing happen to me on a Harley in '69 when I was young and strong and stupid. Fracture/compression 4th lumbar. Settled too soon. My pain is still with me. Take your time. Don't know your age but it might take 10-20 years for you to realize that the pain will never go away. It's not something you will want to deal with on your own. Good luck.

Been thinkin about your situation a little. Your prob. might be that you didn't go down directly as a result of the hole. What you need is an eye witness in your favor. Check police reports for name of the person behind you. There is a motorcycle specific atty here in SD that could help you. Also, ask brent to archive this thread. What you said on this site about what happened to your back when you hit the hole is evidence.

I used to ride a buell.. My wife got me a nightster for Christmas and that is what I was riding. So are you saying my optimized riding skills are to my disadvantage? I probably could have avoided the damn hole if I was on a race bike as opposed to a 600 lb HD.

So, you have Googled "motorcycle attoney" and none of those want the job on contingency? That IS odd. Maybe they are all to busy. Might be too soon for them to make a decision, I guess. But, if you can't work or need lots of health care it is quite important for you to keep accurate records and have council now. Keep trying. First thing is you have to have a solid case against an entity that has $$$. Must be able to prove negligence, for example.

I am surprized the vultures, sorry attorneys, were not perched at the end of your bed when you woke up in recovery. The contractor and the state of California are at fault. Pick a good one, back injuries never go away. Take your time recovering and don't let anyone push you. It's you back not theirs. I wish you a speedy recovery so you are back on your feet driving your Cobra.

It is interesting. No lawyer contacts.. No newspaper articles. All I have heard so far is that the local radio station announced the closing of the highway due to me.

Did you get pictures before the evidence was gone?

From what I was told the highway was shutdown and hole repaired in like 30 minutes with some cold mix. that night after they repaved that entire section of the highway. All I have is the CHP officer that was there, hopefully took pictures and the contractor that was there investigating the situation before it bit me.

Oh no.. its way too painful, even with morphine, to walk. I can do very short stints. Maybe 20-30 feet and I have to lay back down. :(
