I never said the main reason people used the service was for tax evation. I guess my point was not clear. I will try again. TU was a good service. It "allowed" owners to not pay taxes if they wanted to. The states went after the owners because of the taxes "some" of the owners did not pay, and sucked TU and other owners into it. However, if an owner used TU and did not pay the complete sales tax, or registered their car as a 65 ford or some such to get away from "property tax" (we have that in Missouri), then I will call a spade a spade. The owner made a decision to do something that I as an adult would never do. Thats the way I feel, sorry. If states wanted to gather proper taxes and let owners of custom, one-of-a-kind cars be legal, they should have certain exemptions from what is required for big automakers that make millions of cars.
Instead, they make it near impossible. This makes creative people look for loopholes in order to realize their dreams. If there is a loophole, it is legal to use it. The trouble is many people have not thought out the whole process. If someone builds a replica of a 1965 car, they should be allowed the same requirements as a 1965 car. Why is that bad? That said, taxes should be paid as required. |

Good points. In Missouri, the law is written that when you obtain title, you pay taxes on the cost to build the car, "less what you have already paid Missouri sales tax on". So if I bought the transmission in Missouri, and the roller from Ohio (Dynamic Motorsports does not collect Missouri sales tax), I am supposed to pay tax on the roller, and not the tranny. You have to send notorized bill of sales for items like the roller, engine, and components, or no title. This is where my point is, and I think yours also. See, if I go the TU way, I could have reported that I bought the car for much less than what I did (that is up to each person to decide, I am sure TU would let you say you paid what ever you wanted), and paid sales tax on only that amount to get my Missouri title. Also, you could say the car was a 1965 car, and avoid paying some $370.00 (this amount is based on the "value" of the vehicle, based on what you paid sales tax) the first year in "Missouri Property Tax". It drops every year there after, but if you owned the car 10 years, you will pay some $3,000.00 in Missouri Property Tax alone. Over the time that you own the car, the total paid in taxes adds up to be a vacation for the family to Disney World :eek: . Now in Missouri, you can get a waiver for emissions on a hobby car. I have not done it yet, but I am coming up on the requirement quickly. The Federal Government told me I can get a waiver for a car that is not my primary transportation, so we will see. Gentlmen: I am interested in legitimately titleing a new cobra replicar as a 1965 automobile, seeing how it would not pass current emissions tests as a new automobile in the state that I live in (or any other, for that matter). Because I cannot register it as a 1965 auto in my state, I need to go elsewhere. My question is where might I find a company, other than Titles Unlimited, that is reputable and would provide this service. Any info would be appreciated.

Some states allow the car to be titled as a late model (2000+ or the actual year of the build) but registered in such a way as to be exempt from smog certification. It is becoming increasingly difficult in more and more states to register a "specially constructed vehicle". There are no "easy" answers to the problem.

Register a vehicle where the year of the vehicle is misrepresented to avoid compliance with California smog laws. My 2 cents:
I can understand people wanting to have Cobras when California gave them no avenue. And I condone their actions that made it possible for them to own these cars. Now that they have a way to register them, legally, that should be the only path they take. I feel that taxes should be paid if owed. At the same time, California should grant some sort of amnesty to let people take advantage of recent changes in the law. That would be the right thing to do. There are other states that allow specially constructed vehicles to be titled as the year they are constructed to. I feel that if a person with a legal '65 from another state moves to California, they should be able to register their car as a '65. Why some states insist on making criminals out of honest people because they wish to interpret other states' titles differently is criminal in itself. I suggest that a special crimes unit would contribute more to the welfare of the residents of the state if it would concentrate its efforts on street gangs, drug peddlers, thieves, rapists, child abusers and other hard criminals than persecute some poor bastard because he is in love with a 1965 car. |
bart, what 1965 car ? an ORIGINAL would be a 1965, but not these tupperware or tin can replicas...made/constructed/kitted or whatever in late 70s thru today ! mine is registered in Mich as a "1998 assembled vehicle" as that is when it was first registered in the state. it ain't no 1965 ! in fact, in mich, the state assigns their own concocted VIN numberunless it has been registered elsewhere , so my car has two vins : one from spf and one from the state..and the latter also has its own vin decal with THEIR number affixed to the car and installed under the watchful eye of the gendarmes. taxes ? hey, what ya paid is what you are taxed on. now, mess with the purchase price amount and thereby cheat the state out of their tax dollars, then it is a four letter word: J-A-I-L ! just another view. bill, 1998 lookalike to a 1965. NOT a 65, just a replica of one.

Oklahoma is not so bad...the State just repealled our emissions inspections because of questionable inspectors amoung other things. Our car tags cannot cost more than $65. I pay $20 plus another $10 for my vanity tag (COBRA-SC) per year. When I read about Turks plight with the California DMV et al, I am really glad I moved to Tulsa. I'm sure there are plenty of other Californians that are just as glad I moved too.
To each their own...I go back once or twice a year. Some states would probably be just as tough as California if they could get away with it. Clois Harlan |
