Maybe the 2 of you can explain to this guys 15 yr old daughter about how her Dad won't see her graduate, go to prom, get married, have a baby, etc etc etc, because a man killed him with his car while nearly twice the legal limit (.13). But I guess it's ok because he feels bad about it and he honked his horn and flashed his lights before hitting him with the passenger side of the car..... An everyday citizen could have served the same time just for teh DUI, let alone the Manslaugter charge that carries a max of 15yrs. BTW, Bentley GT 60-0 is 118ft. He had time to flash his lights and honk but not slow down.... This arrogant rich guy was pissed that someone was in the road. He slowed but not enough and meant to just scare the man. The alcohol inhibited that and he hit the man. |

It's a tough thing to wrap your head around, no doubt. But let me ask you: a person who also drove home with a .13 and didn't cause a death...
Just as guilty or not? The law says no, but this now brings luck into the mix. I don't recall any laws regarding luck. (except maybe in Vegas) Also should celebrity status matter? I would say no but we both know that's not the case. Should a Policeman or a Judge be held to a higher standard? ( a different matter but it would seem to be part of your logic here) There's a reason we have "attempted" crimes - INTENT. If someone dies because you F****ed up, wether it be alchohol, yacking on your cell phone, not getting that brake job, picking your nose, or hundreds of other causes. The punishment has to fit the intent no matter how bad things turned out. If your an Azzhole, the Judge can deal with that as well. |
Oh, if you don't like the NFL's decision. Don't buy their stuff or go to the games. Or, God forbid, write them a letter. They will only care when the coffers are empty.;)

Agreed.That's why there is: Manslaughter negligent manslaughter Murder 1 Murder 2 Intent is already figured in.I want you or anyone to convince any jury on the planet that since"he" was picking his nose,his intent was to run down a jaywalker. |

There's a basic flaw with the "automatic" fault being given to the DUI driver because "the driver was impaired from avoiding the accident". It may or may not have been a factor. Most states have some type of "failure to avoid" law but it's, by nature, difficult to prove. I do not agree with the idea that one fault negates another. Jaywalking is dangerous at best, if not suicidal. Again we're delving into "intent", perhaps the guy was suicidal. Since a DUI was involved I'd bet this was never even looked into. Never know, wierder stuff has happened... |
