Montana LLC registration
Hi all,
Do any of you register you car through a LLC in Montana? I am in the process of purchasing a new BDR and the salesman gave me some info on Montana LLC's as a means to register my car. I am hoping someone has some experience with it that can help me to make the right decision and or just give me some insight as to how it all works and if you would recommend it or not. thank you, Kevin |
I'm not clear what the advantage would be.
I registered SPO1862 in my name. The process required inspection by a police officer; that and a few forms, with an affidavit of construction, were all I needed to register the car in about three weeks. Be sure your supporting documentation shows the car to be registered replicates a design first constructed and sold to the public in 1965. That way the car qualifies for the exceptions specified for vintage cars, i.e., no front license plate, emissions as of the date of the model being replicated and a few others. Sorry if you already know all of this and my post stumbled over the LLC opportunity. |

A lot of RV folks register their rigs in Montanan due to lower taxes. As state budgets get tighter, they may spend more effort to stop this practice.

Montana has no sales tax. So if your plan is to avoid paying the sales tax there could possibly be an advantage to the LLC. It will cost you every year to re-register your LLC and you must have a local "agent" that represents your LLC. If you will be driving your car and residing in another state be aware that your home state will probably go after the unpaid taxes with penalties. The registration process is the same for an individual as a LLC. The reason that I know this is because I have a Montana LLC and reside in Idaho. My Cobra and Moter Home are both NOW :o registered in Idaho.

I registered SPO1862 in 2004. The registration identifed the car as a 'Shelby Cobra.' As I learned more of Shelby's efforts to clear his name from any vehicle in which he did not have an interest, I followed the advice of another Superformance owner in the NW part of the state and re-registeded the car as a 'Cobra.' The folks in Helena were easy to work with.

I noticed that Kevin is located in MA. I don't know about Massachusetts, but if you run around for too long with out of State plates in California, they might bust you.
A buddy of mine moved back to California from Montana a couple of years ago, but kept his car registered to a company that he had part interest in at the time. A cop finally pulled him over and said that he'd watched him drive by with the MT plates for 6 months, and that it was time to register the car in CA. :) |
