Registering in Canada?
I originally posted this in another thread.
How are you guys registering your Cobra's in Canada, specifically, Ontario. I live in Ontario and also have a house in Florida, but USA non-resident. I woud buy a Cobra either here in Canada or the USA if I thought I could register it in Canada, or at least bring it across the border and pay the GST if registered in Florida. I looked in the DMV site and it states "No Kit Cars" Also E Mailed a builder in Niagara Falls that I found in Cobra Country, but no reply. Thanks |
I am from Canada and as far as I know you are correct in saying Transport Canada won't allow a cobra in from the states. There is a guy here that bought one in the states three years ago and has had it in storage in the states that long while fighting with the government. Your best bet is to buy one in Canada. Then there is no problems.

I too am looking for a cobra and im the same boat as you maybe we can work together in finding out if it is possible to bring one in legit or not people are doing it, but how and if its legal im not sure. |
Correct me if I am wrong, but it appears that a Kit Car can be purchased asembled and registered in Ontario but NOT imported into Canada.
I also assume that "parts" can be imported into Canada, but not a completed kit car or roller. Am I right? Anybody recommend a supplier in Ontario? Thanks |
I know of two in Quebec and no problems with registration...D&D cobra.... pigeon performance.

You have to look for Cobra's that are 15 years or older. No problem to bring in if it's that old.

Did anyone take the time to read my link?
You don't get it...it goes beyond Countries.....you can't transfer Kits from province to province...even if you move. The Cobra "Kit" has to not only reside but has to be born where it is registered to put it simply. No more fake 1966 glass body fakes and no more province to province or out of country imports. This is new and real enforced. They have a task force touring shows and looking for VIN and seizing them. A lady who spear heads the Kit car program for MTO is Pandora and she appears on a kitcar Blog on yahoo. (Let me know if anyone wants it) To sum up. 4 options Kit car VIN (in birth place) Rebuilt VIN (in birth place) Home made VIN(in birth place) Original Cobra VIN (free range) |
If you intend to own a Cobra ...........read it ....all

Actual Conversation with MTO
Hi Ivan and Steve, and everyone,
I'm not sure what you find so mysterious about the *rules and regs.* Are you talking about the vehicle importation restrictions? The comments you made show you really don't appreciate how the safety standards are applied federally and provincially. Frankly, the government is not interested in hearing opinions about how wonderfully a kit car or a turnkey specialty vehicle was engineered, or by whom. The government doesn't care about opinions, they want the paperwork from the manufacturer, period. They want *proof* it meets Canadian federal safety standards, or if not, they want an invoice showing it's only a few parts, not a completed vehicle e.g. kit car body and frame, and that it's not going to be sold outside Ontario, if it's being built in Ontario. Even if you build a wonderful, much improved new type of car, if you want Transport Canada to accept you as a new vehicle manufacturer, you must have sufficient vehicles in production to afford crash testing them. Most specialty vehicle manufacturers don't produce a sufficient number of cars yearly to make it worth their while to crash test (and thus destroy) some of their vehicles. You need deep pockets, not just great engineering. Basically, you can't import a *completed* kit car, even if it's disassembled. Because it doesn't meet Canadian federal safety standards for *new* vehicles. You also can't sell a completed kit car across provincial borders--it then falls under Transport Canada's jurisdiction, and the new vehicle standards apply. If the kit car was assembled here in Ontario for an Ontario purchaser, provincial safety standards for a used motor vehicle are all that applies. After you provide invoices for all major component parts, then you just need a safety standards certificate, and make sure you have all the minimum equipment specified in the Highway Traffic Act, such as a windshield made with safety glass. I have all that listed in the ohcv Files Section - the kit car registration requirements. Have you read that yet? Please do. The United States and Canadian federal safety standards are very similar, so there's usually little problem importing most regular production vehicles from the U.S. You can see the basic information on U.S. importation (NOT kit cars) at the Registrar of Imported Vehicles website: www.riv.ca RIV is an agency working for Transport Canada. If you're bringing a kit from the U.S., such as a Cobra, again, it can't be a complete vehicle, and you'll have to complete assembling it here. You can pretty well forget about importing any type of completed vehicle, including production cars, from any other country, including the U.K. Their safety standards are not equivalent to ours. Any Caterham kit car would have to complete being built in Canada, and I know of a few people who are building Caterham kit cars here in Ontario. You can be very sure any Caterham you see being driven in Ontario wasn't assembled in the U.K. Please get this straight -- any imported vehicle has to be approved to be let into Canada by the federal government, namely, Transport Canada. If you're confused, don't speculate, call them! Toll-free: 1-800-333-0371. I've already uploaded into the ohcv Files Section, a letter from Transport Canada from Harry Baergen, which explains everything you need to know about importing a kit car. Please READ IT!! Ivan and everyone else who wants Transport Canada's position on importing kit cars. If you read it and you still don't understand, then post about what you're confused about. Sorry if I sound a bit cranky, but isn't anyone on the ML reading the ohcv Files Section? The federal and provincial rules and regs aren't a mystery, they're already posted in the ohcv Files Section! I began my Cobra search back in the late 90's. Not wanting to make an error I began to do my homework and one of the first calls I made was to Transport Canada in Ottawa. Take my advice do not waste your time calling them. The only thing they told me was that it was illegal to build, own, drive, import, register, use, a kit car in Canada. They asked me if I knew of anyone building or selling kit cars in Canada as they would then go there and shut them down, seize the cars, etc. The person I spoke to seemed to be a total idiot.
This is the first that I have heard that a kit car built in one province could not be sold or re-registered in another province so this is news to me. I noticed that MTO said that selling a completed kit car across provincial borders falls under Transport Canada jurisdiction. I would think that this would only apply to a business selling a completed kit car across a provincial border. I cannot see how Transport Canada would get involved in a personal transaction of me selling my used Cobra to an individual in another province. The car would simply have to pass a safety inspection then be re-registered. I have said this many times here at CC. You cannot import a kit car into Canada as it does not meet Federal safety standards and has never been crash tested. However it is legal to import car parts. If someone wants to import a kit, they must bring it in as car parts and they are probably best to not try to import all of the parts at the same time as the Canadian Customs officer may decide that it is actually a complete car, but in pieces. This is one of the reasons that I decided to build a Johnex as the body, frame, suspension, etc were all made in Ontario. I purchased other parts in the US as well as in Onartio and here in Quebec. I went through the safety inspection process and registered the car in 2001. Wayne |

Registered as what? A Kit or Rebuilt |
My car has an SAAQ registration number (SAAQ is the Quebec auto insurance dept since we have no-fault insurance here). The car is registered as follows: make - home made; model - Cobra; year - 2000.

To put it simply. You Cobra can not be a Cobra if it is a 2000 unless it came from Shelby America and or Superformance. "Home Made" under their sanction requires you to prove that you built the frame (scratch) and body and a very large percentage of the parts used. very rare, as this title is often used and given to utility trailer builders and not kit builders. Lastly, Do not think for one second that you are safe since it made it under the radar and or it will be given amnesty due to some grandfathered rule. My strong inside sources have informed me that they will eventually contact all (including you) to submit evidence backing your title. Also there is a task force (Mounties) un-uniformed obviously walking cruise nights and car events jotting down VIN numbers and car notes, then latter punching them in for examination. They will and intend to pull some of the road unless they comply. A good friend of mine has already received a notice in the mail. This may seem like some sort of blitz crack down or govt cash cow.....but it is real. BE PREPARED |
Welcome to the communist dictatorship we all love to call CANADA. Heil Hitler! I am so glad the Government protects us so well from our selves as we are all idiot's and can't possible think for our selves. Maybe they should stop wasting time and tax payers money on crap like this and start worrying about things like the billions of potholes in the roads, bridges falling down, huge waiting lines in hospitals, overcrowded schools. Just my 2cents.
