If you own a 10 year old used car and need a body part replaced due to an accident, insurers are obligated to restore your car to the condition it was in prior to the accident. Replacing your used, 10 year old, body part with a brand new part is not "like for like". It is actually returning your car to a better condition than it was before the accident. No insurer has that obligation. If they can find a "used" body part from another car and then install it and paint it to your satisfaction, who cares? So what happens when somebody takes out a Cobra? How does the insurance company go about fixing it assuming it has maybe 5k miles and the car is 10 years old? Will they shuck out $10k (or more) for a new all aluminum engine if the block is ruined?
I don't think the issue was replacing with new parts. I thought the issue was related to replacing with inferior parts. In many cases, I would much rather have a used part than a new part popped in Vietnam or somewhere.
