My 2010 Volkswagen doesn't have any stickers saying unleaded only so that's not mandatory, at least for imports.

The flap is there to reduce emissions when refueling. The hole for the nozzel is a pretty close fit so when refueling not a lot of hydrocarbons escape. When you pull the nozzel the flap closes to keep vapors in while you screw the cap on. The EPA regulates emissions at fuel stations too.
That's my understanding.
