I don't know the ADR words at all but logically you would think there would be need for some downward deflection to minimise risk of hot exhaust blast against adjacent legs as a practical outcome. This only for side pipes as generally capable of pointing at an adjacent kerb.
But then I learnt a long time ago, legislation is not always practical - lol
I'll be interested to hear what the legal requirement is specified as in this case when you find out!
