ANT,
Cut the vertical tube in question about 20mm above the welded tube cluster on teh bottom, and cut at the top, grind the remaining connection on top off. Then insert a matching tube at the angle you want for clearance and weld to the stub and top.
The only result is the vert tube load that is keeping the top horizontal frame member in tension then will only offset the load point and slightly unequal the horizontal tension amounts. No boggie.
