Invalid argument.

She broke the law and was caught, tried and found guilty. This is much different than what a gun COULD be used to do. In fact, if you use a gun to kill someone - and get caught, tried, and found guilty - the penalty is quite a bit more than a simple (albeit expensive) fine.

That said...

I wonder if someone will (successfully) challenge the law as being a form of taxation applied unequally. Seems to me that they need a good lawyer to take up the challenge!
