I think the manufacturers get around this by not selling kit cars complete (less engine and tranny)? Section 216 (2) defines a "motor vehicle" as ."any self-propelled vehicle designed for transporting persons or property on a street or highway." A kit car less an engine is not self-propelled. Additionally, I believe it's up to the individuals States to interpret EPA regulations... EPA can sue a State for not complying with or enforcing EPA regulations.
