I served in combat in the Army during the first Gulf war, and I can tell you that the vast majority of enemy killed were combatants. War is brutal, but nobody takes as much precaution to avoid colateral damage as we do.
As far as justification for the current war in Iraq you have to look no further than the 17 violations of the cease fire from the first Gulf War. You may not agree with the reason that was given for going back, but we could have attacked Iraq after the first violation and been justified.
