It's a dilema. We can't really put the genie back in the bottle, but it started before Bush was elected. Terrorists neither perfectly fall into the prisoner-of-war catagory nor common domestic criminals. Domestic terrorists might be Bloods or Crips. POW can be detained anywhere, I believe.
A lot of detainees have already released by the Bush administration, but as in war, only those that we can be reasonably assured aren't an immediate threat to us or the world. Sometimes it's a toss-up and we don't always guess right.
