Just as guilty or not? The law says no, but this now brings luck into the mix. I don't recall any laws regarding luck. (except maybe in Vegas)
Also should celebrity status matter? I would say no but we both know that's not the case. Should a Policeman or a Judge be held to a higher standard? ( a different matter but it would seem to be part of your logic here)
There's a reason we have "attempted" crimes - INTENT.
If someone dies because you F****ed up, wether it be alchohol, yacking on your cell phone, not getting that brake job, picking your nose, or hundreds of other causes. The punishment has to fit the intent no matter how bad things turned out. If your an Azzhole, the Judge can deal with that as well.
