There's a basic flaw with the "automatic" fault being given to the DUI driver because "the driver was impaired from avoiding the accident". It may or may not have been a factor. Most states have some type of "failure to avoid" law but it's, by nature, difficult to prove.
I do not agree with the idea that one fault negates another. Jaywalking is dangerous at best, if not suicidal. Again we're delving into "intent", perhaps the guy was suicidal. Since a DUI was involved I'd bet this was never even looked into.
