Why? No California Registration

Following disclosure from the Barret jackson auction on lot number 685..

Totally restored with original 427 sideoiler. One of the final 6 completion s/c 427's. Factory aluminum body and fuel cell. Restored by showcase motorsports the largest authorized shelby dealer. Currently registered with oklahoma title. ***427 S/c compeltion car cannot be titled or registered in state of california ( will not comply with emmission stds)***

Why?
Why would an original 1965 Cobra have a difficulty complying with emission standards in California. I don't get it!!

Re:

Turk,

I saw the car too and heard what they said. For what it's worth to ya...

- an out of state vehicle is suppose to be subject to CA-DMV/BAR verification process, regardless of year.
- won't pass the tailpipe test, definitely a gross polluter per BAR
- title probably says *yr of manufacture 2002 etc, model year 1965
- because they "can't guarantee" it can be registered in CA

Any enforced tailpipe test is the killer. So, jet it or carb it way down for the test on any out of state pre-registered car, and cross your fingers.

Gordon Claunch 01-19-2003 03:08 AM

What about the sb100, aren't people registering as 2002 special construction, but smog is the engine or body, car most resembles, how are people getting other cars registered with, say a 60's model engine, but building them this year??

Re:

Hey Gordon,

I'm not sure if your response was to me, but in my exerience registering as a SPCNS "Specially Constructed Vehicle" in California is a very different scenario from trying to register a new/manufactured say CSX4000 car as a 1965 Shelby American Cobra.

With SPCNS/SB100, you should be OK under the guidelines you mentioned - if you don't mind registering your car as a SPCNS. (as you built it yourself - right?) Its a good thing they came up with SB100 for us. What does it really matter, the real/original Cobras were built in the 60s anyhow... we all know that. This is why CA/DMV won't let you register them made new today as a 1965 Shelby or Ford, but they'll let you title/register it as a 1965 special construction/SPCNS. And, as you probably know, it all depends on who you meet at the DMV counter, what code books they are willing to pull out, and their interpretation of what the codes mean. Its a crap shoot, "like a box of chocolate" & "ya never know what yer gonna get" said Forrest Gump.

My .02 cents worth,

When Shelby first started the continuation Cobras I looked into getting one. Even though they are made completely from stored 1966 parts the Calif. DMV. wants their money and told me that since the cars were completed in 1998 or whenever it was, the date the parts were made and stored were irrelevant. Since Shelby is a licensed specialty car manafacturer the cars can't come under SB-100 ( per our DMV ) because they are special construction since they are made from real 1966 parts that were stored. Sort of a paradox I said and then things got really shi--y. My understanding was he is using CSX numbers that they had for these cars and I can't see the DMVs reasoning at all. All of the other 49 states obviously can't either. So they have to meet the smog requitements for the year they were actuallly assembled and shows as sold on the pink slip. I have a 1965 Comet which I pointed out shows sold in 1994 to me so what is the difference. Then I was told to leave as they weren't going to talk to me any more. The Republic of Gray Davis has struck another blow for glorification of stupidy and ignorance.

Yep,Manufactured,thats the difference

"Original" Continuations - Here we go again!

Turk,

If the car was one of the final 6 completion cars, it is not a CSX4000. It was built as a complete automobile, with drivetrain installed and was one of the cars that Ol' Shel tried to pass off as 1966 vintage parts that just happened to be assembled in the 1990s. As a recently manufactured car, it does not qualify under SB100 and does not meet the definition of kit or specialty car. Registration in California would be accomplished only after the vehicle met all applicable new car standards.

Ron61,

During the middle of Shelby's continuation car saga, The Los Angeles Times published an article about Carroll's claim of finding a stash of 1966 Cobra parts, including chassis. Evidently, it turned out that CS's "original" chassis were of recent manufacture and created by famed Cobra restorer Mike McClusky.

Additionally, Carroll claimed that he had registered the missing serial numbers with the State of California and had titles for the all original yet unassembled Cobras. He jes' couldn't find the paperwork!

I have a copy of the letter from Brian Angliss (AC cars) to CS wherein Mr. Angliss states unequivocally that AC Cars only sold completed cars (less drivetrain) to Shelby.

A lawsuit resulted in a settlement wherein CS admitted that his continuation cars were of recent manufacture.

This 1966 parts mythology cointinues despite the fact that Shelby hisownself signed a statement to the contrary!!!

I'll see if I can dig up the documents and post them before Evan jumps in.

Stan,

Thanks for the information. Now I understand a little more about just what was going on. I still really don't see why the other 49 states will accept them and Calif. won't, but that sure clears up a lot of what I couldn't understand about them. I know that someoone here would have the real information about this.

Thanks,

Ron

Ron61,

My recollection is that the California DMV forced Shelby to stamp the continuation cars' titlles with the disclaimer about being not being titled in California.

That is not the same as stating that it CAN be titled in the other 49 states.

I'll try to attach Brain Angliss' letter here.:p

In the following press release, CS admits that the continuation cars are of wholly American manufacture. That would include the chassis. See bottom of page 1, top of page 2.

Stan,

Thanks a lot for the posts. Now I really do understand just what went on. I can now refer another person who was as confused as I was to your posts and he can read them for himself. I appreciate the time you took to get this information out so I could read it.

Thanks again,

Ron

I am in the car business, and if I don't understands it....it says a lot about California and a lot more about me!

Recently I have heard a lot of success stories about California registration process, I am still worried silly about MY visit to the DMV. Never goes well for me there, even when I am just driving through the parking lot.. This should be interesting. Stay tuned!!

What if I had bought that car from a private party without a disclosure and brought it into the state...what then?

Excaliber 01-19-2003 09:47 AM

I thought it was pretty clear there were no authentic continuation cars. I'm VERY surprised the auction would "mis represent" these cars to buyers. They are an interesting car, got some Shelby fingerprints on them, but it's terrible that ANYONE would try to pass them off as "original". Seems to me it's down right illegal.

Hey, what did it sell for anyway? I'm in my new house and haven't got cable yet, you guys are killing me watching the show and I can't!

I find it difficult to get anything sent here from another state. People just assume that if it is cool fun or potentially cool or fun you are prohibited from doing it here.

I suspect the listing in the auction was in error. With the aforementioned SB100 and SB1578 rules in place it can be registered here if you have a great deal of patients and way more understanding of law than the average citizen needs or the most helpful DMV representative has...
