Not A Merry Xmas. Totaled Truck & Injuries
 
A lady rear ended me, totaling my truck and injuring my neck, hip and eyes

I was going 30 mph in a zone and she was going 60 mph and wham,...she nailed me. Now my 76,000 mile Dodge Dakota Quad Cab is totaled. This happened back on June 25th, my Birthday. She let her insurance lapse on June 4th.

We have underinsured motors, but the insurance money won't come close to replacing another truck, so were screwed. I've had two surgeries on my neck so far, the third will be after the other two have healed.

Both of my eyes had retina's tears from the geforce, but have healed, so I don't look like I have red zombies eyes. lol....

But, I'm blessed I'm here with family to enjoy Christmas !

That's terrible but glad that Christmas finds you on the way to healing. Have to watch for those ladies and their SUVs. Hope things look up for you in the new year.

Was she on her cell phone???

How is insurance handled there? In Colorado and Nevada you have to have active insurance to register and they cross check at the DMV. If the insurance lapses the DMV is notified and plates are pulled so you can't pull the trick of getting insurance, getting registered, and then canceling. The problem is that the minimum insurance is so low that it practically wouldn't cover anything.

I looked in my mirror, saw a lot of a white car. She was looking down, then opened her eye's wide, like scared to ****, then hit me. I had no time to do anything. Happened so fast.

Around here in Ne. if you are pulled over they will ask for your insurance card, but a lot of people just say I have insurance, but I don't have the card with me.
And that's it.

I just hired a attorney to see if I need to sue her. I went to a physical theraphy, twice a week for eight weeks, doctor appointments, hospital etc, before our insurance received the bills, so all of that money plus my and co-pays, we paid out of pocket. We should get the payback this week. I can't turn my head to drive yet, but hoping maybe next week. We don't know what to do about replacing the truck ?

With my bad health and bills before the accident, we are strapped for money, so the 5k we get for the truck, minus 1k on buying the truck back from the insurance company, the 4k won't get us crap for another one. Maybe
200,000 miles & a rust bucket piece of crap !:o

Oh, forgot the front seat is broke and my 3 year old kick ass custom stereo is broke inside and doesn't work, hitch system is all bent up. Newer tires and newer stainless dual exhaust with MagnaFlow mufflers.

The bed is sagging down 5'' so the hitch is about 4'' from the ground. We have a fairly flat driveway, but when backing out, the hitch scrapes the street.

Anybody interested in a Cobra with a new 428 with 8 stack injection and new TKO 600 ? :rolleyes:

I'm sorry to hear of your woes, the main thing is you are here, and on the mend.

Your attorney needs to sue her for your losses, medical and motor vehicle etc.

You have suffered enough, why should you lose due to her negligence?

She is the one who should be selling property off, to fund the innocent party, you in this case.

She was looking at her phone, and ran into the back of truck with a 30mph difference.

If she ran into a brick wall at 30mph, she might not be here.

She needs to lose her licence for a lengthy period.

I wish you well moving forward.

You can sue, you can win a judgment, but the chances of collecting are almost always practically nil. She has no assets and will declare bankruptcy. Most attorneys will want to be paid in advance in cases like this since there are no deep pockets into which they can place their hands so it will end up costing more than you'd have a chance of recovering.

I agree, but still have hope. Wish dad was still here, as he was an attorney.

Part of my neck surgery was to deaden 4 nerves on my right side and 7 in my right, in hopes it will knumb the cronic pain. It has helped some, but not enough. I'm a pretty positive man, but I beleive I'll never be pain free. This is on top of my other pain from a child accident, which left me with 24/7 headaches. We'll see what happens with the neck.

Chronic pain is awful to live with.
I have my whole lumbar area, L4-S4, especially L5-S1.
Can't do any of my previous type of work now, not even change a tire, and changing spark plugs or valvetrain adjustment is out.

I feel your pain Kevin.

I can't even lift my billet aluminum flywheel on my new engine. Sometimes Just looking up sends me down on my knees.

I am really sorry to hear that and I hope that you will soon be on the way back to normal. Here if they pull you over and you tell them you don't have your insurance card they will impound your vehicle until you take proof of insurance to them. We have so many dopers that get insurance for one month from some fly by night insurance to register their cars and then don't have any insurance after that month so they have made the laws stricter which is one time I agree with them. Now if they would just enforce the cell phone and texting law.

Hi Kevin,

My back is from swinging spanners, engine blocks and heads, and anything else heavy related to cars for 35 years.
I had a fall down a set of slippery steel steps which didn't help. I have taken painkillers daily for about 4 years, 2 operations, about 20 needles now.
Sometimes I can't pick up the simple things, like a sock on the bedroom floor.

A few of us are all in the same boat, working too hard and getting older.

I have had to put up with back pain for 20 years now as I slipped on a tile floor and it was just a very small slip but my back twisted and messed up some vertebrae. I went to several doctors back then and they all told me that surgery wouldn't stop it from getting worse as it got older and they all told me that they would advise against the surgery. Some days I can't hardly get up or down or bend to do anything and other days it isn't so bad. So I can relate to what you are going through and I hope that yours will get much better.

I blew a disc some time in about 1985. Put up with pain meds and tried physical therapy but it kept coming back. I had disc surgery in 1988. Doctor told me then it might work for about 10 years. I still have occasional episodes but I take care and don't do "bold moves", ie, hiking in rock scramble is practically out of the question, and even climbing a ladder is done with extreme caution. When it gets real bad I've had steroid injections but haven't had to do it for about 6 years. I had a MRI a few years ago and the dr told me it was L3-L4, L4-L5, L5-S1 and it would be fusion, which would mean severe restriction on motion.

Then two years ago I had a horrible shoulder pain. I thought it was rotator cuff, but it turned out to be a pinched neck nerve. That took 6 months of PT and three steroid injections.

It's hereditary. My mom and uncle have back troubles and both of our daughters do too.

This is part of the reason I have to sell my FGT, it's just getting too hard to get in and out and turn my head to see out of the right side mirror. Now it's trucks and SUVs with backup and right hand cameras with better visibility.

Glad to hear your stories, but sorry to hear of your pains as well.

I hope everybody can get better, but we can all agree that lower back pain is with you for life.

WOW, it would seem that more of us than I suspected have the back and shoulder pain. All I can do is wish all of you a better year next year and hope the pain eases off some.

I had three hours of tests today (ug...) and the fourth artery needs a stent, same as the other three. This one is quite small, born with it, and my Doctor thought it may have to have a stent last time, but wanted to wait and see.

So Monday morning I go under the knife.

Actually, in the wrist. lol
Lucky, not under the "Rib Separator" ! :eek:
