Need to ask a legal question...

about credit card debt.....if anyone is willing to answer it (no funny stuff..LOL), please send me a PM. It has to do with the statue of limitations, which I understand is 5 years here in Florida....PLEASE????????????????:confus ed::confused:

Ron61 01-28-2008 04:38 PM

Earl,

I can't help you but you might get a response a lot quicker if you post this on the All cobra Talk forum where most of the legal people hang out.

Ron :)

Earl,
Here's some info that should help.Looks like 4 years in Florida.
The trick is when it starts and you having written proof of it.

Statute of limitations on debt collection

States of Limitations on Debts

EarlsflyinCobra 01-28-2008 07:13 PM

Thanks Ron.....you too Fred......I had already found those two sites Fred, thats what brought up my question......hopefully one of our legal friends will reply.

Jamo 01-28-2008 09:13 PM

jaysusphukingchrist...how many phuking lawyers do you know about here at CC besides Evan and me? (Actually, there are a few others...they're just smart enough to stay under cover) I tried to help you last time you had a question (thought I was helpful) so why not PM me?

If you want to contact Evan...PM him.

There are also some folks here that work with credit...maybe they can help????

And Ron was phuking wrong...it's not an All Cobra Talk question (not even close).

Now, I'd like a blowjob...anybody? Please? ;)

;)

Well, I just figured if we were gonna start a barter system...there certainly are some corksuckers around here. :JEKYLHYDE

Earl,

Don't worry. Jamo wasn't referring to you and it isn't you that he is pissed at. I started another thread to tell you this before I saw that there were two of these and Jamo had locked the one down so I will now put it in both places.

Ron :(

EarlsflyinCobra 01-29-2008 07:23 AM

Thanks Ron and Jamo

I wasn't thinking too clearly yesterday....I had been to the dentist in the morning....(being a law enfc. ofc. for 30 plus years I'd rather go into a building where I know an idiot is hiding with a gun than go to the dentist)....and he had scheduled me for a root canal today....got myself all psyched up for it then about 15 mins. ago they called and cancelled it due to the dentist being sick.....oh well, things happen for a reason.....Jamo I will PM you as soon as I get another chance...thanks to both of you....and yes, Jamo you have ALWAYS been very helpful and I wish I could return the favor BUT I draw the line at anything below the belt....hee-hee:3DSMILE:

trularin 01-29-2008 07:36 AM

Well, this thread deteriorated quickly.

:D :D

Excaliber 01-29-2008 09:56 AM

Right down the tubes like flushing a toilet! :D

I understand the time frame of limitations can EASILY start over by something as simple as a phone call (letter, e-mail, etc.) to the credit card company inquiring about the statue of limitations concerning the specific card. Any number of things can reset the clock, even a letter claiming the time frame is 'over'. Be careful with this tricky aspect.

392cobra 01-29-2008 10:28 AM

Earl,
If the credit card co. has sold your debt, they sold it for pennies on the dollar to a collection agency. You will be able to settle it for 1/2 or even less of the original debt.
You have to be very careful in dealing with them.If their lips are moving they are lying.

There is also the moral side of this.
If you used your card and received goods and/or services in exchange, you should pay them what you owe them. Statue of Limitations or anything else shouldn't be a consideration.

Receiving the goods and/or services and not paying for them is theft.

About the best I can do to help you out on that one would be to start a collection and kick in $10.00.;)

trularin 01-29-2008 10:45 AM

Jamo, you need to find the person in Fred's avatar.

:D :D

Maybe you could get Jamo a gift certificate to one of those Brothels in Nevada. :JEKYLHYDE

Hmm, it might be interesting explaining that charge on your credit card to your significant other... "But honey, it wasn't for me, I bought a gift certificate..."

Doug I 01-29-2008 11:25 AM

I wonder if Fred's and Turk's avatars are related .....

Ron61 01-29-2008 11:29 AM

I don't know but they remind me of the one that Daniel Bonyhadi used to have. I have it on a disk somewhere but haven't been able to find it.
Turk is smooth and when he is done thanks the woman and she isn't even sure what he is thanking her for. Fred on the other hand ............

How about a combination of your avatar with a big grin smiley?
:D
