1/6/2009--Introduced.
Blair Holt's Firearm Licensing and Record of Sale Act of 2009 - Amends the Brady Handgun Violence Prevention Act to prohibit a person from possessing a firearm unless that person has been issued a firearm license under this Act or a state system certified under this Act and such license has not been invalidated or revoked. Prescribes license application, issuance, and renewal requirements.

Prohibits transferring or receiving a qualifying firearm unless the recipient presents a valid firearms license, the license is verified, and the dealer records a tracking authorization number. Prescribes firearms transfer reporting and record keeping requirements. Directs the Attorney General to establish and maintain a federal record of sale system.

Prohibits:

(1) transferring a firearm to any person other than a licensee, unless the transfer is processed through a licensed dealer in accordance with national instant criminal background check system requirements, with exceptions;

(2) a licensed manufacturer or dealer from failing to comply with reporting and record keeping requirements of this Act;

(3) failing to report the loss or theft of the firearm to the Attorney General within 72 hours;

(4) failing to report to the Attorney General an address change within 60 days; or

(5) keeping a loaded firearm, or an unloaded firearm and ammunition for the firearm, knowingly or recklessly disregarding the risk that a child is capable of gaining access, if a child uses the firearm and causes death or serious bodily injury.

Prescribes criminal penalties for violations of firearms provisions covered by this Act.

Directs the Attorney General to:

(1) establish and maintain a firearm injury information clearinghouse;

(2) conduct continuing studies and investigations of firearm-related deaths and injuries; and

(3) collect and maintain current production and sales figures of each licensed manufacturer.

Authorizes the Attorney General to certify state firearm licensing or record of sale systems.

This bill is being kept way below the radar

Lightbulb Good to be vigilant...

But this one is a non-starter. He introduced it over a year ago and all it does is lie on the committe table, with good reason. It has -zero- sponsors, because all know that if they put their support to it they'd be looking for work after the 2010 elections.

Not to mention that it would have no chance of withstanding challenge after the Heller Supreme Court decision.

I think we're very close to this happening. Unfortunately these idiots in government won't heed until the bullets start flying.

Personally, I welcome it. We've gone beyond what the electoral process can correct. Don't be surprised to see states start threatening cessation. (besides Texas of course) Cowboys and Politicians will be the new great American pastime.

You must have read the joke about the cowboy, Indian, and Politician. The old cowboy was leaning on the bar having a drink and the Indian was there with him when the Politician came in. The Politician had to have attention so he started on the Indian about how they had lost their land to such low and uneducated people as the cowboy. At this point the cowboy put down his glass and said, Yea, but we ain't played cowboy and politician yet.

Not exactly the weay the joke went but I don't remember it correctly.

In any case, re the 2nd Amendment, just about any casual student of history knows why Thomas Jefferson (of all people!) LOVED the Second Amendment. He loathed the concept of a strong central government anyway, but he realized (as most Americans should) that we became Americans principally and primarily because we ALL had guns back then.

A couple of conservative professors (maybe the only two left in the United States!) were on Da Tube a couple of days ago and they said that, if you graphed individual freedom over the past 150 years, it's been going downwards since the Civil War! Yar, it's obviously subjective, but Yikes! anyway!

I'll be 64 next Thursday, and I cannot imagine what my life would be like if I were 10 years old, let's say. I thank Zeus that I was born in 1945. Living on a boat in Florida in the 1950's, going to college in the 60's and serving in the navy on tin cans. Not much I regret. I even had enuff money to live on Olde Cape Codde and own a buncha little boats.

I've got enuff guns to arm a small regiment, and I ain't gonna surrender them to anyone. I hold very little hope that "The Great American Public" will "finally wake up". They won't, they don't have the collective IQ to figure out that they're a buncha frogs approaching the boiling point. As Hyack (sp?) said,they will be enslaved by a dominating, thieving and lying liberal-fascist mega-government. "Wake up", me arse. Almost half of this country voted for that hollow suit spewing snake-oil. Hope and change me arse.....Good luck, young 'uns!

You are correct, Professor - the Questionable (as opposed to honorable) Bobby Rush is indeed ex-Black Panther, and a Chicago (sheesh - where else??) politician. Seems Mr. Blair Holt was protecting his girlfriend and took a bullet for her - or so the story goes - and the Questionable decided he would honor the memory by simply removing all guns from society. Hey, someboddy got to, right?

We do, however, need to elevate your $.00002 to something more in line with the veracity of your information.....let's make it $.20
