Poor baby should be ariving at its temporary (I hope) home at Scotts Coach Works this evening or early wed morning. Phone conversations with them seem very promising.
Thanks to Bob Broberg for the suggestion of where to take it, same recommendation from Dave Shulak. From what I saw on Daves coupe they do fine work. Have not heard from the ladies insurance company yet so I guess its time to inform (again) them of the error of her ways. Hope Stuart is doing fine and out of hospital soon. Jeff |
Jeff, I spoke with her insurance people today. While they assured me that she has more than the state minimum required, she doesn't have enough coverage to pay for all of the vehicles. They advised me to deal with my insurance company and they would contact them directly and arrange to pro rate the payment by expense percentage. She did say that she would try to get me a check to cover my deductable. That's generous of them. Good Luck buddy. I hope they make it look like new. I only wish I had that option.

Dan,
If she comes up short on her insurance, how is it given out? Divided equally among the individuals, first come first served, or? Then, can you go after her personally for the difference? It may be attorney time! (Some of my best friends are attorneys. I hate what they do until I need them. Then I become their best friend!) I would hate to be her, but if I came up short, I would try to find a way to compensate the people affected. Easy for me to say, but I feel that way. I just hope she does! One good thing. It looks like there are a bunch of cars for sale. Not too many Contemporarys, but a whole bunch of Superformance for some reason!? Good luck finding a car. If you get to Scripps Ranch, you can be the "grand marshal" of the Cobra group. Or how about a ride with the IV girls! SkipB Checking my insurance tomorrow! |
It's her responsibility to pay any expenses beyond her insurance. It may be like getting blood out of a turnip though. Maybe she can sell a kidney!

I believe the BEST way to go about it is to let your insurance handle it. File the claim through your insurance company and let them do the work to get their money back. That's what my insurance company recommended when I had a nonfault accident. I figured when I seen the damage that her insurance wouldn't be up to cover all the damages.

Sounds like you guys are starting to get your ducks in a row.
Anybody find out how badly she was injured? Mike |
my understanding is your insurance covers the losses and then sues her insurance to get reimbursed. Don't sign a release for sure. I think her coverage is for each wreck not all the wrecks as one. I hate to say it but a good lawyer might be needed.

Your insurance company will pay the agreed value to fix your car by contract. You did specify an "agreed value" didn't you? They will institute proceedings to collect the amount needed minus your deductible from the responsible party's insurance company, if there is one. I believe that 40% of Arizona driver do not have coverage. My cobra was wrecked on Thanksgiving, 2003. After a 7 month, $28,000 repair paid for by my insurance company, it took my insurance company and Glendale Prosecuter's office 5 years just to collect my deductible from the uninsured, none liscensed, twice convicted for DWI, unemployable driver but, I got it. The perpetrator is now serving time but still broke. Trust your insurance company, sign with a respectable one and play the game.

Been there done that. Let your insurance company handle it.

Mike, When I visited Stuart he told me that she was a couple of rooms down from him a few days ago and all that she had were burns from the air big... Dave
|
Thanks, Dave...
By the way.. How are you doing? Mike |
The "other" insurance will pay up to the limits of "her" policy,in this case, with more than one vehcle involved, her insurance will pay on a pro-rated basis, so that all parties are compensated equally,% wise.....

First my thoughts and prayers go out to Stuart for speedy recovery. After working ER and Trauma for 15 years I can honestly say that anyone who has a "face to face" encounter with those stupid cable barriers and walks away is blessed.
I have no doubt things would have been much worse if not for the quick action and bravery(for those who have driven on the US 60 freeway you understand) of those traveling with him. |
Stuart, I am sorry to hear of your loss, but happy you're going to be OK, well OK as only you can be...%/. Never mind on Barb and I borrowing the Mustang looks like you are going to need it for route 66, yes you are not getting off that easy! Get well, heal and we will see you at the end of the month.
Stuart if you need anything, please let us know. I did get your message and had no idea it was this bad until I read the post... I would hold off on that line lock for a while.. and let us know when you need some food, we owe you one! Take care, we will call soon. Barb and Brian |
Doing good Mike....Start rehab on Monday.....Dave

Not to be insensitive but after reading about Stuart’s mishap and his luck I totally forgot to mention my regards to Dan and Jeff. Once again the stupidity of one person’s actions can change the fate of many. I am so thankful that you both were not in your cars or even worse your wives could have been in the passenger seats. Everyone was truly blessed that day.
Cars are objects that can be replaced but to a true car guy it still hurts and the knife digs deep. After talking to Stuart on the phone I could not imagine the world loosing him or any of us to such a tragedy. Even though we do not see each other all the time we are still a tight knit group and would do just about anything for each other. With that said Jeff you are in good hands with your car at Coachworks and I hope they work quickly to get you back on the road. After riding in that car with Mulv it would be a shame to not have such a good car on the road. Dan there is always a silver lining and yours is the decreasing American economy… Right now there are wonderful deals out there and I hope you can replace your baby with a new one, although it will never be the same as the first I am sure. And great job fellow AZ cobra owners for helping friends when the chips are down, as we have seen in the past (DaveS comes to mind) when something happens to our own we have a knack of responding quickly, and I know If I would have been there I would like to think that I would have been able to contribute somehow. Keep the shinny side up, |
Thoughts from Northern CA
Prayers, good wishes and speedy recoveries to Stuart and everyone else in AZ from the North Bay area of California. Heroism takes many forms and it sounds like there were true heroes that day. I think every Cobra owner who reads these pages will be touched to some extent and sense the "brotherhood" that Cobra driving brings. Even though I have "policed" a number of fatal accidents, these events always leave a mark.
I guess there is something to be learned by the rest of us. Personally, when in a Cobra caravan, I think I'll allow a little extra room between me and the next car. |
I have been out of the loop for awhile due to surgery and just read the disturbing news of Stuart. My husband and I spent the last two Cobra Bashes with Stuart, just hanging out and getting to know "Tan Man". Any idea if he is still in the hospital and if so, where? We would like to send our support his way. Any further info would be great. Our love and support goes out to Stuart.

Stuart was with us on the Fun Run and is doing well with the exception of having to have someone else sign his bar tab and speeding tickets.
