I do appreciate everyones input, but for the record, I have no intention of doing anything illegal and I don't think those who posted such ideas were really serious. And, I can't go up and get the car for a couple of reasons the biggest is that I don't get paid during the summer (teacher) and I don't have the money to finish the car and make it through until the next paycheck. I would have to get the car and some money from JCF and that plan has already been rejected. I have given up on the car and bought something else and it will have to do. I am also resigned to the fact that John may never be honest with me about why he has not built the car, but if he can live with it I'm going to have to.

"I would have to get the car and some money from JCF ."

Mike:

I think the odds of what you would like to happen are next to zero. It would appear that you have two choices. The first is to arrange to go get the car, then determine the cost to finish it. If it is a significant amount, then you have to decide on whether or not to bear the time and expense of commencing a legal action (i.e.; hire an attorney and try a case in a location eight hours away) and endure the possibility of an uncertain outcome. The alternative is to sue for breach of contract, demanding a full refund. However, this too, will, after legal fees and months, if not years of legal proceedings, never make you whole and will never get you back the six years you have lost.

My recommendation is to cut your losses; take the car as is and move on; you'll be ahead of the game.

Jim

Thank you for your input and I agree that the chance of my getting the car (at least in the near future) are pretty slim. JCF is contracted to send me a check every month that the car is not delivered and John/JCF is not in violstion of that contract. If I go get the car I have to pay to go get it and pay to finish it as opposed to getting a check every month until the finished car is delivered. Right now, the car is 6 years and 3 months past the first promised delivery date. A few more years, at this point, doesn't matter to me.
