No order for discovery. 11:50 am Pst Gary reported the court is in recess and finished for the day. Intially Justice Carter was leaning to dismiss the case and accept Defendant’s MTD, however Orly Taitz and Gary Creeps made a very impassioned arguement and the gallery burst into applause, the Marshalls did not stop the outburst, and it was felt Justice Carter was swayed by the outburst to not throw out the MTD but rather reconsider his decision. http://www.meetup.com/WeSurroundThem...hread/7810705/ |
Another "birther" suing over Obama's birth certificate? Ridiculous. Hawaii State Law does not allow the State to release the original certificate of Live Birth. So the issue is: Can Federal Law over ride State Law in this case and FORCE the State of Hawaii to produce the document.
Can a State or Federal agency FORCE you to provide a DNA sample? Yes, depending on the circumstances, they may have to go to court to secure it. Why don't you just willingly give it up when they ask? Because there are principles involved, ethics involved, why should you just "give it up"? Same principle applies here. There is more than sufficient data, testimony, legal paperwork, etc. to establish the FACT that Obama was born in Hawaii. Producing yet another "certified" copy of live birth will NOT stop the "birthers" anyway. That's the very nature of conspiracy theorists, no matter what logic you apply, they cling so tightly to their belief's they will not be satisified, no matter what proof may be offered. This case will be dismissed at some point, and the "birthers" will argue foul, period. They will be crying "foul" for the next 100 years, regardless of paper work, legal filings, rulings or opinions. Even if it came from the Supreme Court itself! |
One question, Does anybody know if any other of our presidents had an issue with providing a certified copy of their birth certificate? If not, Why does Obama have an issue with it?
You have to admit that it has to put a big question mark on the issue. I feel that anyone running for the POTUS should have to provide the certificate when they officially start their campain. If they don't then they are SOL. Both of my sons could not even sign up for little league without a certified copy of their birth certificate. Terry |

Question I have is what if he's disqualified? Does the Presidency fall to the next highest vote recipiant (McCain), bump the existing up an notch, (JoJo and Pelosi):eek: or special election? |
I don't know but I would hope a special election is held. I would assume Biden would assume the role until the election is held, but if the candidacy was not eligible for election then they should not be able to reap the rewards of a fraudulent election. This is if it is found to be ineligible. I do think this whole process will spark a change to where a candidate must prove their legal eligibility to run for the office they are running for.

Bummer Awnold can't run! :) Seem's to me certified copies HAVE been produced, and rejected by the "birthers" as fraud or less than original or some other reason... I'm not sure at this point WHAT would put the issue to rest. Hawaii government officials are on record, under oath with statements attesting to the real and correct birth certificate authenticity. So the Little League coach says, "How do I know this is REALLY a certified copy. What else you got?" :) |

It can’t be that hard to go to the hospital where he was hatched and get a registration check of the births for that day…I mean, this isn’t rocket science. There is going to be some file in some storage or microfiche which is going to list his mother/father entering a hospital…and leaving with a baby. Hell, even a search of the local papers for baby announcements. I’ve got my fathers’ paperwork from the early ‘40s and it wasn’t that hard to get it.

SPF2245, all that has been provided, researched, documented. What were missing here is a "letter from his mother", near as I can figure THAT is what the Judge wants to see in this case. Being as she has now passed away, Obama is in a real jamb. :)

The Obama camp has spent much more than that sealing quite a few officially (and usually released) records by their own accounting. For example; 1. Obama's admission records and transcripts from Occidental College, and 2. Records and transcripts from the Chicago Law School, Harvard, and yes, 3. his original birth certificate. As has been noted earlier, Hawaii does not release originals without the subjects consent and Obama has consistently refused to permit this release. It is very odd at best, since BHO has made a case that the drama surrounding this issue has been a distraction from more important affairs. As this is a direct constitutional issue, it would seem that the release could be forced by a willing court since BHO is definitely 'in the limelight' and not protected by the privacy laws of normal citizens. Can you think of a reason why he gets by without releasing all these documents? Would you have been so condescendingly assured if GWB had refused release of his National Guard records? And for all the would be constitutional scholars, the line of succession is quite obvious; 25th Amendment, Section I: "Section 1. In case of the removal of the President from office or of his death or resignation, the Vice President shall become President." |
Thing that scares me is if the ticket is deemed fraud that kinda ties Biden to Obama's hip, which would put Pelosi in the driver's seat.:eek: Biden could claim ignorance (which most everyone would believe).:LOL:
Thing I was asking about was the Kenyan Birth Cert. that some ex-army Col. smuggled out of the Hospital BO was born in. I'll have to poke around and see if I can find it. By the time Arnold leaves office California will be a burned out hulk, that should be enough to keep him out of the White House. (right up there with Bill Gates' swan song, Vista):rolleyes: |
I think if it does come out that BHO is ineligible to be POTUS, and if he were removed from office (both doubtful, IMHO) it would be chaos in the US, and possibly civil war. And with Biden in the chair, God help us all! :eek:

I would not predict disaster. After all, the people most upset would be the same ones that said they would leave the country forever if GWB won a second; and I believe most of those pos are still here. They seem prone to big talk and very little action (especially if it comes with a personal price). There would be a lot of yelling, maybe a few riots in the ghettos, but would calm down soon IMHO. The BIG issue would be Biden in the Oval Office....that may take decades to recover from! :LOL:
