Remember, you are the one who approached him as a buyer for a car that was never listed for sale in the first place. JBo negotiated the terms and conditions in good faith with you. Both legally and morally it's your fault that the deal went south. Again it has nothing to do with being a dictator, you failed to close on time and you lost your deposit because of it. Make threats to take him to court, but you will lose because you did not follow through in the timely manner in which you agreed to. Can't type it up any clearer than this. I know you feel it's unfair, but you have been in business long enough to know it right up front when you set the wheels in motion.

All things (and parties) considered, what he did.

Since I did not originally have the car up for sale, but had an unsolicited offer from you, and we originally negotiated the terms together, and you did not follow through, I would have done the exact same thing that JBo did. Face it, he did not screw you out of 5K, you screwed yourself out of it by not following through by not acting in a professional and business like manner. If I was in his shoes, I would be thinking "I'm not going to waste any more of my time with this guy, as he is not a man of his word".........Since you broker, buy, sell expensive watches, you do know how larger ticket sales go. Same goes for a commercial or residential property, if you had approached me to sell my building, then you did not follow through on time per the contract to purchase, you would lose your deposit and that is that. The deposit is earnest money to keep you from backing out of the deal and wasting everyones time. If the deal goes south, hopefully the deposit is enough to cover the time and energies wasted...In this case, you were the one who wasted JBo's time and he has the right to be compensated for it. Once again sorry if my response gets you angry, but you did ask the question and wanted my honest answer, or you would not have asked the question in the first place.
