OK, fair enough.

The relevant legislation is here:

This is a link to the Transport Operations (Road Use Management—Vehicle Standards and Safety) Regulation 2010 Schedule 1.

so first up we have this statement:

1 Non-application of standards--inconsistent ADR requirements
A provision of parts 4 to 12 of these standards does not apply to a vehicle if--
(a) the provision is inconsistent with a requirement of a second or third edition ADR applying to the vehicle; and
(b) the vehicle complies with the requirement.

Then we have Part 9 (included in the above statement 'a') Division 2, Exhausts Systems (under 130). So if you comply with the requirements of the ADR, or the information included in this legislation is inconsistent with the requirement of the ADR, this standard does not apply.

this means we head over to the ADRs. Here is a good start:
ADR 42/04:
Vehicle Standard (Australian Design Rule 42/04 - General Safety Requirements) 2005

Note that this ADR does not have any requirements for Category MA vehicles (or in the case of the AMG Mercedes a Category MC):

So as part of their sales pitch: "AMG exhaust system with twin chrome-plated side-exiting tailpipes (left and right), oval and visible"

So this Benz falls in the category of the same legislatation, (Class MA and MC are both <4.5t GVM). Regardless of ICv status or not, the NCOP is a guideline, and the vehicle is compliant with the ADRs if you have live side pipes. QLD makes allowance for it under it's own legislation.
