If he was asking 100k + for the car it would be ridiculous, and all of us would have a good laugh. But, I think he is just selling it on a website that gives him no other choice. Until ebay adds a search area for cobra replicas I really feel it is in the right place.

Now, with that said, I would never put the word Shelby anywhere else in the advertisement. When I am asked what I own, I always say Superformance Cobra. AC or Shelby would never be implied by me.

Regarding CS being angry....he has no one to be angry at but himself. Just like Ford let some knucklehead copyright the name GT-40, he "walked away" from that car in the 60s and never said anything for over a decade. It was only after guys started to become wealthy that he even cared. Pig headed and selfish.

Ok, we have bashed Shelby to death over the years. Time to let it go....Time to starting picking on the lawyers.Arfter all, the only ones who ever win in a court battle are the lawyers :D :D :D .........

Anyone want to buy a real Shelby Cobra for cheap? Best offer over 50k and it's yours. Everything about it is real.

Webster defines "KIT" as: set of tools, supplies, for a special purpose; case to contain these objects, SET OF PARTS TO BE ASSEMBLED.

CSX4027: Type in "Superformance" on a Ebay search and see what happens. THAT'S why he calls it a Shelby Cobra - just smart on his part,; he's trying to sell a car. He also states many times that it's a SPF (also good advertising on his part). Just as if someone were selling GAP jeans they would probably list them under Levi's.
........although, I wonder if people selling guitars would be better off listing them as Shelby's or under Gibson?? How 'bout pop-corn venders??? ....... shall I continue??

Don't just pick on the SPF guy. The REAL people trying to rip you off are the ones selling the "Shelby" Durango's, Chargers, etc...at a SHELBY "premium". Or, the guy in this months DuPont Registry trying to sell his '67 Shelby "Elenor" GT-500 "replica" for 175K "FIRM". ........ouch! Bend over please!!!!!!:eek:

TerrySPF: Sorry. Just look at the ad. He is clearly trying to take advantage by calling and referring to his car as a Shelby Cobra. Its not. All he had to say right up front was "Shelby Cobra Replica by SPF".

He clearly chose to do otherwise with a specific intent.

I happen to Like the SPF's and certainly have no bone to pick with them or their owners. I am very close to the Snakepit guys and hold them in high regard.
It's really any guy that try's to capitalize in a less than ethical manor.

Evan: I DID look at the ad (you're a lawyer, you know to always do your research before making a statement!). It says: Shelby Cobra "Superformance" 2002 "New". It's listed under: Shelby - all models (which is what Ebay lists it as), which means "all Cobra replica's included". ........at least that's MY defination of what it means. Now, if Ebay expanded the site to say "Superformance Cars" and someone still listed their SPF under "Shelby", THEN you would have a case, counselor!
Let's not give Shelby a reason to start another lawsuit!

I think the key word is the one read first "Shelby".
When you read the ingredients of anything in a package. The first Item indicates the highest percentage of that ingredient in the mix. ie; Water in Coca Cola
The ad should then first say Superformance Cobra Replica
Shelby Cobra Superformance gives the onlooker that has no experience with Cobra's the same mixed message as Jumbo Shrimp.

There are 2 places to potentially list a Cobra for sale

1 - Shelby

2 - Replica/Kit Makes

So why do some Kit Cobra's sometimes get listed under Shelby?

And others go under Replica/Kit Makes?

Only Shelby made cars should be in the Shelby section and other Cobra's should be in the Replica section with the ad starting with the respective manufacturer then Cobra Replica. The word Shelby should have no part of it. It was Cobra that became public domain whenever the dollar thing happened or who-ever dropped the ball story.
-Shelby should be kept out of it.

Obviously if someone really didn't know what they had, I guess ignorance would be a good defense. I am obviously talking about intentional use of strategic words.

In my business I am regulated from using certain styles of advertising.
I can lose my license for telling people..
"I have the best rates possible"
Or The policy will guarantee you a set retirement
So obviously, I am in tune to keeping it to the straight and narrow and would not have it any other way.

I know that I would most likely list it something like Evan suggested "Shelby Cobra Replica from Unique" under Replica/Kit Car heading.

I would have the Shelby Cobra in the heading because many would search that way. If you search under just Cobra, or just Shelby, you come with to much other crap. I would put Unique in there just to be upfront and besides, some one may be looking for a Unique. And 'replica', well just because. If some one doesn't like that, don't buy it.

I don't for a minute think the guy was trying to mislead any one. The general public knows them as Shelby Cobras or simply Cobras. Most know that there are replicas but few know one manufacturer from another. Hell isn't what most of us refer to our car as, a 'Cobra'? I could call it 'Betty', but no one would know what the f&%* I am talking about:LOL:

Time to wrap a few things up so I can go take a drive on this beautiful day in my Cobra!;)

My understanding with the Series 1 cars was in order for Shelby to pursue building them he needed buyers to put down money. These people were promised a car at "X" dollar amount and when the car was nearing completion the price went up to "Y" amount. Some wanted deposits back, and did not get them and when the car was finally complete they ended up having to pay the uprated "Z" figure. Which now they are all real pissed b/c they can't sell them for a fraction of "X".

I wonder if anyone has a copy of the original contract that was signed at the time of deposit on those cars?

If so, why not post one to clear up the conflict.

I was not involved in the Series one at all and would like to know.

But, I have had construction work done at my house and more times than not the price went up during the job due to unforseen circumstances. I wounder if the contract had a clause because was a completely new item with unknowns to it?

If you want to find a series one owner that has first hand knowledge of the price change why dont you call RAY F.

One other thing. Go to the hemmings motor news website. Do a searh for a used vehicle. Superformance has a place on the search list as does factory five, unique, and a few others.
