Default Perhaps It is Time to Move On?

I am not an attorney and have no emotional attachment to the car in question or the two parties involved.

Stepping back from the discussions around could-a, should-a, would-a, seems it comes down to three questions:

1. Was a binding contract in-place that defined the terms of the transaction for both parties - Yes

2. Did the binding contract specify terms (deposit, timelines, etc) that were agreed to by both parties - Yes

3. Was contract executed by both parties according to the original terms of the contract - No (have read nothing that suggests to me that this is not the case)

So, at days end, if binding contract was not executed according to original terms accepted by either of the two parties involved, then default agreements defined in this contract then come into play.

I may be looking at this too simply, but as an ex-auditor, you always start your due diligence at a contract level....

I do have to give Lewis credit for one thing. No matter how many times he got knocked down, he got back up and tried again. Not a very smart lad, but he is determined.

I think, and again remembering I am not representing a legal opinion here, that recent cases in both government and private business suggest that e-mails are in-fact, binding documents. I know that in my company, we spend a significant amount of money archiving our e-mails for just these purposes.

First off, you screwed up, plain and simple......My guess is you were going to "flip" the car and it didn't work out and you lost....you threw the dice and it came up snake eyes....put your tail between your legs and quit.....as others have said, when you find yourself chest deep in a hole, QUIT DIGGING.........

Now, too calling everyone here a "redneck",well, that's where I take offence.......not everyone here is a redneck and your actually giving true rednecks a bad name by doing so..
We have Cajuns (like me), we have yankees, we have them folks in the republic of kalifornia,we have a bunch of guys from down under and England of a whole bunch of other foreign countries and we even have one big ole Armenian!!!!!!!!!!!!!

I have met and do know a handful of your fellow countrymen and I must say, I have liked them all,so you must be the exception to the rule!!!!!!!!!!!!!!!!

Well, Bill, technicality anyone north of the Mason-Dixon line is a yankee with the exception of kalifornia...like the fellow said in Days of Thunder, "you ain't a yankee, you ain't really nothin"

But there are exceptions to every rule.........I have met as you know a bunch of guys from up north and after getting to know them, I wouldn't really refer to them as Yankees, just good ole boys and friends.......
I guess I grew up thinking the term yankee was not a good thing to be called, so even though your "technicality" a yankee just because of your location, doen't always mean your a "yankee".........

I (and several others) accepted more than a few personal shots, but we let it go for benefit of all mankind's enjoyment of the singular humor afforded by the guy on the streetcorner selling watches from his trenchcoat.
