Actually, your story of getting yanked out of the car and handcuffed is not too far off from my experience that evening...yes, it happened, and they were in fear of their lives when they pulled me over...They did not know if I was the robbery suspect or not, if I had a gun or a bomb in my car that evening...Do I condone it, no, do I understand where they were coming from so as to not make a big stink over it, yes, I do.......If your local police would not cut you some slack for forgetting your wallet on a local run to the market, then you bring it up with the police chief or prosecutor and get it taken care of by showing proof of those documents......If your 25/50/100+ miles from home, and you cannot produce identification proving you are who you say you are, then by all means, the police have the right to put you in jail or write you a ticket if need be. Black, White, hell even Green/Orange colored skin does not play a factor in what I see in my travels through Bergen, Morris, Essex, Warren, or Sussex Counties. At least not when I go by a police officer with a stopped vehicle....Same goes for the vehicle itself, everything from the mom and pop grocery getter, to the modern muscle cars, pick up trucks, and everything in between.............

Guess we must be living in two different worlds...............Put yourself in their shoes for a day, think about it from their standpoint....I mean really think about it, and then you'll see why it is the way it is.................

Bill - no question they have a different perspective - living in the world they do, BUT, if you've ever been on the other end of a false accusation situation, you would understand why people develop total disrespect for the authorities. My 19 yr old son was falsely accused of being involved in a B&E a few years ago. Despite our irrefutable proof he couldn't have been there, the word of a couple of thugs prevailed over our sons explanation. "Tough luck - see 'ya in court" was the cops comment.

Yeah, tough luck plus $20k of legal fees and numerous declinings of their plea bargains. They dropped the case 2 days before going to trial - when they realized we wouldn't back down and they had to finally investigate my sons version of the events in preparation for court.

Very hard for me to teach my son respect for the authorities after an incident like that....not to mention the numerous "hassle" pullovers he has gone through.........

If police would be allowed to practice "profiling", Bill would get pulled over everytime he got behind the wheel.
If they only knew WHO was driving the car..

I dont think we are living in two worlds at all Bill. I have a retired Chief of Police and a State Trooper in my family. I have a huge respect for law enforcement. They certainly have one of the hardest and most dangerous jobs in America. But I still feel that some people are unfaily singled out, that there is abuse of power at times and $500+ for lack of documentation is unnessessary.

$500.00 to someone making $25,000 a year can be devastating. While the M.D. making $500,000 is just inconvenienced. Sometimes I wish there was a better way.

Not to add more fuel to a already emotional thread about being pulled over.. but!

It is ironic you in YOUR car without proper documentation can be fined for NOT having the proper "papers" on you, however police in California can not ask the motorist about their legal status in the country.

No one else sees anything wrong with this?

A policeman can ask me to see myhlicense, registration, insurance information but he can't ask if I even belong here?

The cops are out there to bring revenue into the town/county/state. These idiotic 'Safe Corridors' are nothing more than revenue producers. Our Governor and Legislators don't give a rats behind about double fines, then state surcharges then insurance surcharges and increases in premiums.

There was a time when Police Officers were looked at with respect and they 'kept the peace'. You considered them part of the community, a public servant, a neighbor. Then some time ago things changed to 'Law Enforcement' and it became us against them. Why this occurred I don't know.

Let's not overlook the big thing in this case; it's not the cops who set the fines, it's the legislature. The legislature is the real problem, the cops are merely there to enforce the law as written. Hopefully, if one got pulled over without their wallet (which happened to me once- and that was not my only "infraction" ), the local cop that pulled you over would exercise some discretion and cut you some slack. The amount of the new fine$ are ridiculous.

Do we get and insurance surcharge along with our $ 500.00 ticket? That would make it $ 1,100.00 ticket.

Within my experience as a police officer in New Jersey I can tell you that I was never asked to write tickets as a revenue generating mechanism for the municipality I worked for. In the case of "No DL/Ins/Reg in possession" that was usually written when you pulled someone over for speeding and didnt want to give them points. (FYI - if in the discretion of the PO, you dont have current insurance (expired ins card, for example) your car may be impounded and the citation requiring a court appearance. title39-6? if I recall, it has points and is much more serious than No Document in possession )

So you may ask why write the ticket? Often, citizens request enforcement (residential speeding, school crossing....). In that case, officers are obligated to issue summones.

Overall, I would suggest that if you're stopped for speeding and the PO offers to issue a No DL in possession, take it and thank the cop.

Cheers,

jong
