Just a question guys, I didn't recall reading anywhere that if the deal wasn't complete by 30 days that the deposit would be nonrefundable. Did I overlook it, or is that standard practice? Not taking sides, just asking.

i know what the facts are , but what would YOU have done in JBo position

Since I did not originally have the car up for sale, but had an unsolicited offer from you, and we originally negotiated the terms together, and you did not follow through, I would have done the exact same thing that JBo did. Face it, he did not screw you out of 5K, you screwed yourself out of it by not following through by not acting in a professional and business like manner. If I was in his shoes, I would be thinking "I'm not going to waste any more of my time with this guy, as he is not a man of his word".........Since you broker, buy, sell expensive watches, you do know how larger ticket sales go. Same goes for a commercial or residential property, if you had approached me to sell my building, then you did not follow through on time per the contract to purchase, you would lose your deposit and that is that. The deposit is earnest money to keep you from backing out of the deal and wasting everyones time. If the deal goes south, hopefully the deposit is enough to cover the time and energies wasted...In this case, you were the one who wasted JBo's time and he has the right to be compensated for it. Once again sorry if my response gets you angry, but you did ask the question and wanted my honest answer, or you would not have asked the question in the first place.

Man, my computer dies for one day, and I miss the beginning of this.
I have noticed that there sure seems to be a bit of a lack of any Aussie buddies coming to this guy's aid. Maybe he doesn't have any for some reason.

I believe I've already answered the legal end of the equation. You gave a day the funds would be there, you missed that deadline, you then waited to renegotiate after the fact instead of being the responsible adult and speaking with him a week before when you knew then that you would not have the funds on time. Pretty cut and dry by your own admission.

Hmmm, the thread starts as someone scammed me, and now it turns to JBo is being unreasonable for not allowing more time. Sheesh, you can fget financing for a house in less than 30 days if you are qualified. To answer the question of what I would do if I was in JBo's place, I would have walked away from the deal as soon as I had a chance since it appered something fishy was going on.

You made the bed ... you made all the mistakes ... you might have got something out of JBo if you were nice. But not now. If I were you, I'd go to another Cobra site.

i did not lie to any one ,i am a watch dealer, not a car dealer, i have owned 200 cars ,most i have sold for a loss, all watches i sell for a profit, cars are my passion.
